I had the same problem. But if you let Oswald fight him, you won't have to worry about it. Spoiler alert: Oswald wins and it ends up being better for his image anyway. So there's a simple work-around, thankfully. But this game is plagued with bugs. It's a great game, just needed more time to work on it.
